Texas SR22 Insurance & Laws

I’ve been reading something DUI/DWI laws in Texas. And I’m curious as to what is the difference between the two. I’ve read somewhere that drunk driving has just too many official names like drinking under the influence (DUI), diving while intoxicated (DWI), OUI (Operation Under the Influence) among others. With that, I’m assuming that there’s no difference between the two after all. Am I correct?

Tony

San Antonio, TX

Well that depends on the states where you live in. Majority of US states do not distinguish the difference between the two however here in Texas it’s not the case.

I’ve asked my uncle who is a practicing DUI attorney in Texas (and obviously knows about DUI/DWI laws here) and found out that there is difference between DUI and DWI.

A DUI arrest falls under Class C misdemeanor. For first time offender, no jail time will be required. Also, the fine for this could go up as much as $500. Plus, you may be required to enroll in a DUI program or do community service and also your license will be suspended. Let’s take this scenario as an example, if you are below 21 years old, you may be arrested for DUI if there is any amount of alcohol found in your system.

In contrast for DWI, driving a vehicle in public roads while intoxicated falls under Class B misdemeanor. You can be arrested for this if there are drugs and/or alcohol content found in your system. You will be deemed intoxicated if your urine or blood alcohol level is more than 0.08 %.

Also, once convicted of DWI, you will serve jail sentence, your driving privileges suspended for 3 months (or 90 days) and attend a DWI program. In addition, if you are caught with an alcohol container open, jail sentence is for a minimum of 6 days. Then also have to purchase Texas Sr22 Insurance in order to drive legally again.

I hope I was able to help you with your question about DUI/DWI laws. If you have other legal questions, you can always contact an attorney who knows something about DUI/DWI laws.

I was just convicted of DUI. What happens now?

Alex

Houston, TX.

Alex,

Sorry to hear of your conviction. But in the future you may need to plan ahead and have a designated driver.

Now there are several things that can happen from large fines on top of the fines that you already have paid. To having to complete an alcohol education  course. There could be community service and even an interlocking device put on your car.

This device is a machine you have to blow onto every time you want to start your car. You even have to blow into this machine several times as you are driving. It checks you alcohol level in you breath. Much like the machine you probably blew into at the police station. You will have to have this machine recalibrated every month with a service fee for this procedure.

You are now considered in the high risk category for auto insurance. This insurance is known as Texas SR22 insurance. Which is required by law for you to have after your drivers license is returned to you and you are no longer on a suspended license. This last for a minimum of 3 years.

So as you can see it is very expensive venture and time consuming. But you may get off easy this time but it may cost a lot more the next time. Remember don’t drink and drive.

Hope this answered you question and you found this web site informative.

Thank you for an excellent Question.

Can a DUI Attorney help me reduce my charges?

Ted

Ft. Worth, TX.

Ted,

A DUI attorney can help mitigate or reduce the charges. Remember that these charges should be taken seriously. Being found guilty of a DUI can effect you and your family.  Not all people arrested are guilty. Therefore having a lawyer can help your chances greatly.

A qualified attorney will know exactly what to do. Even if you might have said something while being arrested. They will be able to look at you blood alcohol level. Read you breath, urine, and blood test if taken. If convicted you will also have to have Texas Sr22 Insurance.

Great Question. Thank you.
